IL Supplement to the Payment Terms
The provisions of this Israeli Supplement to the Payment Terms apply to the IL Parties. In this context, reference below to ‘You’ and ‘Your’ shall be read as reference to ‘The Customer’ and reference to ‘Us’ shall be read as reference to ‘Airwallex’
1. CHARGEBACKS
1.1 The following paragraph 8.4 will be added after paragraph 8.3. of the Payment Terms. The consecutive paragraphs (after the new paragraph 8.4) will be renumbered.
“8.4 Notwithstanding the foregoing, if a Buyer notifies its Card Provider or Local Payment Provider of an unauthorized use (Hebrew: Shimush Le'ra'a, as defined in the the Israeli Payment Services Law, 5779-2019 as amended from time to time “PSL”) of the Card or the Local Payment Method, as applicable, in connection with a Transaction at the Merchant, and the Buyer was identified by the Merchant using Strong Customer Authentication (provided that Strong Customer Authentication is available for the relevant Card or the Local Payment Method), then we will not charge you for the Chargeback related to such Transaction, nor for any associated Chargeback Costs and Chargeback Fees, provided that we do not have a reasonable suspicion of a breach by the Merchant of these Terms or Applicable Law, or that the unauthorized use was committed by the Merchant. For the purposes of this Section 8.4, “Strong Customer Authentication” means Prat Imut Mugbar as such term is defined in the PSL. This paragraph also applies in the context of Pre-chargeback Services (as defined below).”
