1) What these terms cover. These are the terms and conditions (Agreement) which apply to your participation in our Promotion which is further described in clause 5. Please refer to our Terms and Conditions for the meaning of any capitalised words if they are not explained in this Agreement.

2) Who are we. We are Airwallex Pty Ltd (ACN 609 653 312 AFSL 487221), a company registered in Australia. Our registered office is at Level 7, 15 William Street, Melbourne VIC 3000. In this Agreement, Airwallex Pty Ltd is referred to as “we/our/us/Airwallex”.

3) Eligibility and conditions. You are eligible to participate in the Promotion if the following conditions are satisfied:

a) You are one of the first 1,000 applicants to sign up and be approved for an Airwallex Account; and

b) You have successfully opened an Airwallex Account using the unique url for signup during the period from 1 Feb 2020 to 15 Apr 2020 (Australian time) (Promotional Period), unless withdrawn earlier by Airwallex. If you are successful, you will receive an email from us confirming that your Airwallex Account has been activated and is ready to be used (Email Confirmation).

4) The offer is not available to existing customers of Airwallex or it’s affiliates.

5) Only one bonus $100 credit is available per approved applicant;

6) If a related party of an approved applicant signs up for an Airwallex Account, Airwallex reserves the right to pay only one bonus $100 credit to one of the approved applicants.

7) For clarity, this Promotion is exclusive to any eligible new customers who received a promotional flyer from us at Pausefest. “Airwallex Account” means the profile to access Airwallex’s Platform through Webapp.

8) What is the Promotion? If you satisfy the eligibility criteria and conditions specified in clause 3 and comply with the terms of this Agreement and the our Terms and Conditions (including any documents referred to therein), then you will receive a bonus $100 credit in your Airwallex Account. It may take up to 30 days for the bonus $100 credit to be credited into your Airwallex Account from the date of the Email Confirmation. If you cease to be a customer before we credit your Airwallex Account, you forfeit the bonus $100 credit.

9) Your acceptance and agreement. You are deemed to have accepted and agreed to be bound by this Agreement from the earlier of (1) the date on which your confirm to us in writing of your acceptance or (2) the date of the Email Confirmation.

10) Not available with other offers. You may not use any other promotions, discounts or offers from us in conjunction with the Promotion.

11) We reserve the right to hold void, cancel, suspend, or amend the Promotion where it becomes necessary to do so.

12) This Agreement will automatically terminate if your Customer Agreement is terminated for any reason.

13) How we may use your personal information. Any personal information you provide to us will only be used in accordance with our Privacy Policy.

14) We may assign or transfer our rights and obligations under this Agreement to another entity by posting on this webpage if this happens.

15) You may only assign or transfer your rights or obligations under this Agreement to another entity if we agree in writing.

16) Our liability to you.

(a) We do not exclude or limit in any way our liability to you where it would be unlawful to do so. You may have rights and guarantees under the Australian Consumer Law and Airwallex does not limit any such rights or guarantees.

(b) We exclude all implied conditions, warranties, representations or other terms that may apply to the Promotion.

(c) We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with the Promotion or this Agreement.

(d) In particular, we will not be liable for: loss of profits, sales, business, or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.

17) We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under this Agreement which is caused by any act or event beyond our reasonable control.

18) We may make changes. We may revise this Agreement from time to time by amending this webpage.

19) Nobody else has any rights under this Agreement. This Agreement is between you and us. No other person has any rights to enforce any of its terms.

20) Which laws apply to this Agreement and where you may bring legal proceedings. This Agreement is governed by the laws of Victoria, Australia and you agree to submit to the exclusive jurisdiction of the courts in Victoria, Australia.
